Terms of Service

These terms govern each customer business's (“you”, “the Business”) use of Member Request Desk (“the Service”), provided by NEMO Australia Pty Ltd (ABN 60 631 429 055). By signing up or using the Service, you agree to them.

The Service

The Service works with Mindbody through its API to verify requests, apply the Business's rules and submit eligible membership suspensions; it then re-checks the result and notifies the member and staff. Requests that fail a rule are routed to staff review rather than processed automatically. The Service is provided by NEMO Australia Pty Ltd — it is not Mindbody and should not be taken to imply Mindbody endorsement or partnership unless that is formally approved. Use of the Service depends on connecting it through the proper Mindbody site activation process.

Eligibility & authority

You confirm that you are authorised to operate the Business's Mindbody account and to instruct suspensions on members' contracts, and that you will connect the Service using the proper Mindbody site activation process.

Fees, billing & renewal

Plan limits

Each plan includes an expected monthly volume of suspension requests, stated on the pricing page, as a fair-use guideline. We do not meter usage per request and do not charge overage without your agreement; if your usage regularly exceeds your plan, we'll contact you to move to the right tier. Any trial length and conversion terms will be stated at the time an offer is made.

30-day money-back guarantee

New customers may request a refund within 30 days of their first paid charge by emailing support@membersrequestdesk.com. The guarantee applies to the first paid charge only and does not apply to later renewals.

Data processing & subprocessors

Where we process your members' personal information as your processor, we will: process it only on your documented instructions and for providing the Service; keep it confidential and limit access to personnel who need it; protect it with the technical and organisational measures described in our Trust Centre; assist you, taking into account the nature of the processing, in responding to member access, correction and deletion requests; notify you without undue delay if we become aware of a data breach affecting your members' data; and, on termination, delete or return that data as set out below. You authorise the subprocessors listed in our Trust Centre; we will update that list before adding a new subprocessor, and flow down equivalent data-protection obligations to them.

Acceptable use

You will not misuse the Service, attempt to access other businesses' data, reverse-engineer it, or use it unlawfully or to suspend contracts without proper authority.

Availability & changes

We aim for high availability but do not guarantee uninterrupted service. We provide kill-switches and may suspend automation for safety, maintenance or to comply with Mindbody's requirements. We may update the Service and these terms; material changes will be notified.

Third-party platforms

The Service depends on Mindbody's Public API and other third-party providers. We are not responsible for changes, outages or errors in those platforms, but will take reasonable steps to reconcile and recover.

Warranties & liability

The Service is provided “as is”. To the extent permitted by law we exclude implied warranties. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the maximum extent permitted by law, our total liability arising from the Service is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential loss.

Cancellation, term & data exit

You may cancel at any time from your account or by emailing support@membersrequestdesk.com. Cancellation takes effect at the end of the current billing period; prepaid fees for that period are not refunded except under the 30-day guarantee above. Automation stops when your subscription ends.

On termination you may request an export of your data within 30 days. We revoke Mindbody access on cancellation, and delete or de-identify personal data within 30 days, subject to legal retention (for example, billing records kept for 5 years under Australian tax law). Backups are encrypted and age out on our provider's standard rotation. Reconciliation and kill-switch obligations survive as needed to leave your account in a consistent state.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have exclusive jurisdiction.
